These Software License and Terms (the “Terms”) govern your download and use of Flight.Atlas from Solve Kinetic, an Oregon business (“Solve Kinetic,” “we,” or “us”). By purchasing, installing, activating, or using Flight.Atlas, you agree to these Terms.
1. License grant
After payment of the applicable one-time fee, Solve Kinetic grants you a limited, non-exclusive, non-transferable license to install and use the purchased version of Flight.Atlas on one server. Authorized users may access that server over your local network or VPN. The license includes ongoing use of the purchased version and updates that Solve Kinetic releases within version 1.x. Future major versions are not included unless stated otherwise.
2. License activation
A valid license key may be required to activate and validate the software. One purchase permits one active server installation. You may not share, sell, sublicense, publish, or use the key to activate additional servers. Contact us before moving an active license to a replacement server.
3. Ownership and restrictions
Flight.Atlas is licensed, not sold. Solve Kinetic and its licensors retain all rights in the software, documentation, branding, and related materials. Except where applicable law expressly permits it, you may not copy or redistribute the software, bypass license controls, reverse engineer it, or use it to create a competing product.
4. Customer responsibilities
You are responsible for the server, Windows and Docker configuration, network security, VPN, storage, backups, user access, and permissions used with Flight.Atlas. Follow the published installation requirements and maintain independent backups of your data and media. Flight.Atlas organizes records and links to media; it is not a flight-control, navigation, airworthiness, emergency-response, or regulatory-compliance system.
5. Updates and support
The purchase includes email support for installation and product issues and updates released within version 1.x. Support is governed by the Support Policy. Custom network design, server administration, data migration, and other professional services are separate services and may require an additional fee.
6. Payments and refunds
Purchases are processed by Gumroad as merchant of record and are also subject to the terms shown during checkout. Prices and applicable taxes are displayed before purchase. Refund eligibility is governed by our Refund Policy and any rights that cannot be waived under applicable law.
7. Acceptable use
You may not use Flight.Atlas unlawfully; interfere with its license or security functions; distribute malware through it; or use it in a way that infringes another person’s privacy, intellectual property, or other rights.
8. Warranty disclaimer
To the fullest extent permitted by law, Flight.Atlas is provided “as is” and “as available.” Solve Kinetic does not promise uninterrupted or error-free operation or compatibility with unsupported hardware, software, networks, or third-party services. Nothing in these Terms excludes warranties or consumer rights that applicable law does not allow us to exclude.
9. Limitation of liability
To the fullest extent permitted by law, Solve Kinetic will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, media, business, or goodwill arising from Flight.Atlas. Solve Kinetic’s total liability relating to the software will not exceed the amount you paid for the applicable license. These limits do not apply where applicable law prohibits them.
10. Termination
This license ends if you materially violate these Terms and do not correct the violation after notice when correction is reasonably possible. Upon termination, you must stop using and delete the software. Provisions that by their nature should survive termination will remain in effect.
11. Governing law and changes
Oregon law governs these Terms, without regard to conflict-of-law rules. We may update these Terms for future purchases or software versions. The terms presented when you purchase your license govern that purchase unless a change is required by law or accepted by you.
